Trinity’s very experienced team of senior disputes lawyers have acted as counsel in both commercial and investor-state international arbitrations in Africa, the Middle East, Europe, the Far East, North America, South America and the Caribbean, under all the major institutional rules including the LCIA, ICC, ICSID, HKIAC and UNCITRAL arbitration rules. In addition, the team has advised extensively on environmental, social and governance issues as well as business and human rights law which is becoming more prevalent in investor-state disputes.

Members of the team have specialist knowledge of arbitrations in the construction, power, energy (including renewables, nuclear and oil & gas), mining, petrochemicals and infrastructure sectors, in particular in Africa and other emerging markets. This enables the team to offer a one-stop shop to the firm’s clients, providing senior level experience throughout the conduct of each matter and at each stage of the dispute, including crisis management, strategy discussions, mediation, adjudication, arbitration and settlement discussions. The combination of the firm’s deep jurisdiction-specific know-how and the crisis management team’s risk prevention and mitigation expertise assist the team to identify potential areas of risk and dispute for the clients of the firm before they arise. In the event that a dispute cannot be avoided and progresses to arbitration, Trinity’s size and specialist nature as a boutique law firm enable the international arbitration team to work closely with the transactional lawyers at Trinity, who have been involved in many of the largest and most complex transactions in Africa and other emerging markets, ensuring a more efficient, robust and focused team who can achieve the best outcome for the client.

The team has significant experience of arbitrations conducted in both common and civil law jurisdictions. As most of the team are native French speakers or completely fluent in French and English, the firm can put forward fully bilingual teams at all levels to deal with disputes in Francophone Africa.

Some recent disputes on which Trinity’s dispute resolution team has acted include:

    • Acting for B2Gold Corp. on a dispute with the State of Mali in relation to the non-renewal of an exploration licence, including the filing of an ICSID arbitration request and the subsequent amicable settlement of the dispute.
    • Acting for an East African power producer in an ICC arbitration against a fuel supplier.
    • Acting for a Chinese company in an ICC arbitration against a national mining company of a Central Africa state.
    •  Acting for a company in the international oil & gas sector in relation to a dispute with a private aviation company.
